Ras Mubarak, a former Member of Parliament for Kumbungu, has initiated a $5 million lawsuit against MTN Ghana (Scancom PLC), alleging contractual breach and reputational harm after the company’s roaming services failed during an international business trip. The lawsuit, filed on November 27, 2024, at the High Court in Accra, outlines significant financial and personal repercussions from the service disruption.
According to Mubarak, he activated MTN’s roaming services ahead of his trip to the UAE, Bahrain, Turkey, and Saudi Arabia in September 2024. However, upon arrival, he found himself unable to make calls, send messages, or access internet services. Despite lodging multiple complaints, the issue remained unresolved, leading to severe challenges throughout his trip.
Mubarak claims the service failure resulted in missed business opportunities, tarnished his reputation, and left him unable to complete essential financial transactions, including receiving one-time passwords (OTPs) for critical payments. The situation forced him to seek emergency funds from his associates and employees, adding further stress to an already dire situation.
The former MP is demanding $1 million as compensation for breach of contract and an additional $4 million for the hardships, inconveniences, and reputational damage he endured. He is also seeking interest on the awarded amount at prevailing commercial rates and full coverage of legal expenses, including attorney fees.
MTN Ghana, in response, issued an apology on October 17, 2024, and offered to waive Mubarak’s post-paid bill for September. However, Mubarak dismissed the gesture, describing it as insufficient and failing to acknowledge the gravity of his ordeal. In his legal submission, he emphasized the profound impact of the service failure on his business and personal life, stating that legal action was his only recourse.
